Imo APC Guber Ticket: Court adjourns indefinitely (Read Details)

Hearing continues today 23rd October, 2018 in the case filled by Senator Hope Uzodinma restraining APC from announcing another person other than him as the flag bearer.

While the Counsel to Mr. Uche Nwosu prayed the court to join him as APC candidate in the suit with regards to the second congress conducted which was granted.
An Abuja High Court had earlier recognized Senator Hope Uzodinma as the candidate of the party for the 2019 Imo governorship election.

The court, which was presided over by Justice O.A Musa said that the Independent National Electoral Commission (INEC) must also recognize only Uzodinma as the governorship candidate in the 2019 election.

Justice O. A. Musa who gave the restraining order, also restrained INEC (2nd Respondent) in the case from processing or publishing the “name of any other person other than Senator Hope Uzodimma from the All Progressives Congress (APC) as the gubernatorial candidate for Imo State Governorship election for 2019” pending the determination of the substantive suit on the matter.
Uzodimma through his lawyer, Joe Agi (SAN) had approached the court seeking an order to restrain the All Progressives Congress (APC) from conducting a fresh or re-conducting another primary for the Imo State Gubernatorial primaries and INEC from monitoring or purporting to monitor any fresh primaries or re-conducted primaries by the APC in Imo State Gubernatorial Election pending the hearing and determination of the motion on notice before the Court.

The court which fixed today for hearing on the matter had adjourned indefinitely, which means that the only subsisting court order at this moment which is the one in favour of Senator Hope Uzodinma, which prohibits the APC from substituting his name as the governorship candidate of the Party and forbids INEC from accepting any other name other stands as the governorship candidate of the APC in Imo State.

The other court prayer by Uche Nwosu in the High court of the Federal capital territory on the 9th of October, 2018 before justice Valentine Ashi on the 9th of October with concurrent jurisdiction with that of the Federal High presided by Justice Musa was done in error in the sense that the party they referred to as defendant in the matter wasn't the "All Progressive Congress" rather "All Progressive Peoples Congress" and the matter of Imo APC Congresses was before then under a court injunction which was not vacated before the General Agbabiyaka led panel that saw the emergence of Uche Nwosu as candidate of Imo APC.

To me, the court decision to adjourn the matter sine die was to off her hand from controversial party primaries or to allow for a political solution or allowing status quo to be maintained.
Therefore, the Abuja High Court today Tuesday, 23rd October 2018 adjourned indefinitely the matter between Senator Hope Uzodinma and Mr. Uche Nwosu both of Imo APC laying claim of the party's gubernatorial ticket.
